You are certainly correct in that in my career I have tried to provide patient care on the basis of the patient's well being and fairness and not on their ability to pay. That is why it hurts to find Janet's claim rejected on a technicality. It is sad that the legal system tends to move in that direction. I can remember the strange legal battle in the USA 2000 election results, with some individuals in Florida having trouble understanding the ballot and voting for the wrong person, with the court just saying "too bad". The word "justice" should mean a just decision as that is the meaning of the word, not just a rigid interpretation of the wording of a law which may not have been what the lawmakers intended in the first place.The SFDCT did not explain with any sensitivity why they wouldn't accept the best proof we could provide them. I asked for an appeal and got a one liner rejecting it. You mentioned the court appeal but I can imagine that will cost me more grief and expense and if the same rigidity applies to that level of the legal system, then its likely hopeless. It is strange that a country like yours which was founded on the principal of equality, fairness and justice for the settlers on the Mayflower has now got so entangled in the wording of laws that justice seems to have slipped through the cracks.I think you are a man that I'd like to meet. We will try the Appeal route you suggested and greatly appreciate your kindness in following up on my letter. Again thanks for answering our questions and your support...

Dear Stephen, It was extremely important for me to let you know how much I appreciate you being in contact with the United States District Court for the Eastern District of Michigan to file an Appeal and Request for Review, and what an outstanding job you and Reena did in documenting my case. Dear Mr Frailich, I received my settlement check from SFDCT from your office today. I cannot begin to tell you how glad I was to see that check in the mail today! As you have said to me on numerous occasions, the money will not give me back my good health, but it does finally provide me with some closure after 14 years, which is when I took my case to my previous attorney, who did nothing for me. The feeling of relief I feel is worth so much more than the money. In the last 3 years you have done an incredible job of obtaining for me, settlements from both the MDL and Dow Corning.

I am convinced that, your dedication, hard work and especially your compassion for myself and other women who have been harmed by breast implants, is what makes you such a special human being and a wonderful attorney. My previous attorney, who I believe I retained in 1991, did absolutely nothing for me and had he been my attorney now, I am convinced I would not have received ANY settlement whatsoever, ever! When I spoke to you for the very first time, I knew that I could COUNT on you to do what needed to be done to bring my claim to resolution. I did not worry even one day since you took over my case. I knew there were a lot of things that needed to be done for my claim to be submitted properly, in a timely matter and DONE RIGHT and you did them all! I never worried about that, EVER! Your frequent updates by mail, phone calls and emails kept me well informed about the progress of my claim. I tried not to call your office or bother you with constant emails as I just knew that you were doing everything that needed to be done and I trusted you would call me with important updates and you did! On the few occasions that I did call your office, I was put through to you personally or my questions were answered by your staff completely and courteously. When it came down to the last appeal and the Geoff White thing, you took the "bull by the horns" and said "this is what we need to do to get this thing going THIS year, not in 2 years"! And because of your efforts in getting the ball rolling and donations by myself and other claimants, claimants like me are finally getting paid this year! I was only able to donate $20.00 to that cause, but it was the best $20.00 I ever spent and I know everyone's donation no matter how small, helped to get the Dow going and helped thousands of other women finally get the settlements they deserve.

The one thing that really bothers me is that on my settlement sheet you noted the amount you have to pay my previous attorney out of YOUR fee as per your agreement for taking over my case. I have been sick for so long and can't afford the doctors as before. I thought maybe someday I would die a broken down lady with no help. Now maybe I can sleep a little better.

Also I noticed in my surgery report that it said something about the broken implants were sent to pathology for examination and that the siliconomas were dissected out. Dear Mr. Frailich, Thank you so much for taking the time to answer all of my emails, even though I am not a client of yours. How fortunate your clients are to have you for council. Had I come across your site 13 years ago, things would have been so much easier for my family and I. To date, most lawyers will not give you the time of day if you do not have a case or not a client of theirs, and even then, they dont get back to you when you have a question.

"Stephen, I received a letter from the SFDCT, dated 11-29-04, indicating that my settlement (Domestic Claimants –Rupture 5) for $20,000 is being processed. The letter states that the payment amount represents the Base Payment. This check will be issued within approximately 3 weeks from the date on the letter.

Am I really on the verge of some closure to this long ordeal???? And, in fact, is this true that the check will be mailing shortly???? I am hesitant to get excited until I hear this information is correct from you.

Please, when you have some time, let me know what to expect. I truly appreciate all of your work and efforts, not only on my behalf, but on the behalf of thousands of women affected by this problem. It is such a good feeling to know there are still people out there who protect those of us who do not know what to do or how to do it.

"Stephen, As the work day winds down once again, I found myself thinking of you and the wonderful and hard work you have done in my behalf. After spending nearly ten years "thinking" I had been qualified and would receive a settlement, I was shocked beyond belief to hear from my "lawyer" that I did not qualify and would receive nothing!

It was only through general net surfing that I was fortunate enough to find you. I was so impressed with your personal commentary that I just knew I HAD to contact you to see if you could be of assistance. From day one, you and your wonderful staff have been at the helm - directing me to the correct physicians for diagnosis, reading through box after box of medical records, promptly answering email inquiries, meeting all the necessary deadlines. What a shock to learn that BOTH my implants were ruptured and there were MANY diagnosis for the medical problems that have plagued me for years!

"Dear Mr. Frailich, I just had to send you this letter to tell you how I feel. I am crying while I am writing this letter. For the last 12 years I have been going through a living hell. After being lied to by my doctor that my implants were safe and would last a lifetime, my health started to seriously decline. No one believed my problems were related to my implants. All the doctors I saw basically told me there was nothing wrong with me, but I knew different. I knew my body, and my body was being poisoned by these implants. The doctor who put in the implants would not help me at all, and has now retired and says he does not remember me. My husband left me with my kids and a ton of bills, and I am struggling each day to make ends meet.

The lawyer that I hired from the begining made me promises the day I hired him. That was the first and only time I have seen him. His staff was rude on the phone and made me feel like a pest, when all I wanted to know was what was going on with my case. God forbid this lawyer would ever have the decency to get on the phone to talk to me.

When I heard about you from a friend of mine, I did not want to start all over again with someone new I did not know. When I spoke to you on the phone (first time I have been able to speak with a lawyer) I knew you were different. You did not preach to me, you just listened to me vent and vent. When I was done, you simply told me in a straight manner what you could do for me. I decided right then and there that you were the man I wanted to hire.

Since that time, your staff has always been helpful and friendly to me, and did not make me feel small. You always get back to me, whether it is by the phone, letter or email. You have never let me down. When I received the letter from the claims board saying I was going to be paid, I was in shock that my case was finally going to be settled. I am still in shock now that I have received the money. I can never thank you enough Mr. Frailich for all you have done. You are unlike any lawyer I have ever met or heard of. I am going to have these implants removed now, and pray to God that my health will return. Us women who have had breast implants and have suffered for so many years, are blessed to have someone like you fighting for our cause.
